These Terms of Service ("Terms") govern your use of CarbSight, a mobile application provided by JCW Digital ("we", "us", or "our"). By using CarbSight, you agree to these Terms.

1. Description of Service

CarbSight is an AI-powered tool that estimates carbohydrate content from food photos. The app is designed to assist people managing their carbohydrate intake, including those with Type 1 Diabetes. CarbSight uses artificial intelligence to analyze food images and provide carbohydrate estimates.

2. Medical Disclaimer

CarbSight is not a medical device. Carbohydrate estimates provided by this app are AI-generated approximations and may vary by ±15-20% or more from actual carbohydrate content. These estimates should not be used as the sole basis for medical decisions, including insulin dosing.

Always consult with your healthcare provider regarding dietary decisions and diabetes management. CarbSight is intended as a supplementary tool and does not replace professional medical advice, diagnosis, or treatment.

3. Account Registration

To use CarbSight, you must create an account. New users receive a 7-day free trial with full access to all features. When creating an account, you must provide accurate information. You are responsible for maintaining the security of your account credentials.

4. Subscriptions & Payments

CarbSight offers subscription plans that provide access to additional features and higher usage limits. Subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel your subscription through your Apple ID settings
• Free trial periods, if offered, will automatically convert to a paid subscription unless cancelled before the trial ends
• Refunds are handled by Apple according to their refund policies

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to circumvent usage limits or subscription requirements
• Reverse engineer, decompile, or disassemble any part of the service
• Upload content that is harmful, offensive, or violates the rights of others
• Use automated systems to access the service beyond normal app usage

6. Intellectual Property

CarbSight, including its design, features, and content, is owned by JCW Digital. You retain ownership of any food photos you upload. By using the service, you grant us a limited license to process your photos for the purpose of providing carbohydrate estimates.

7. Limitation of Liability

To the maximum extent permitted by law, JCW Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of CarbSight. This includes, but is not limited to, any health-related decisions made based on carbohydrate estimates provided by the app.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.

8. Disclaimer of Warranties

CarbSight is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that carbohydrate estimates will be accurate, complete, or suitable for any particular purpose, including medical purposes.

9. Account Deletion

You may delete your account at any time through Settings > Account > Delete Account. Upon deletion, all your data will be permanently removed from our servers. This action cannot be undone.

10. Changes to Terms

We may update these Terms from time to time. Continued use of CarbSight after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the app.

11. Termination

We reserve the right to suspend or terminate your access to CarbSight if you violate these Terms. You may stop using the service at any time.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the applicable courts.
